TERMS AND CONDITIONS

1. DEFINITION OF TERMS

As used herein, the following terms shall have the corresponding meaning:

a. “24k CARD” – refers to the virtual and physical membership card issued by P.J. Lhuillier, Inc. (Cebuana Lhuillier) as part of its Rewards Card Program for its clients.

b. “24k ONLINE WEBSITE” – refers to the web and mobile responsive website of Cebuana Lhuillier

c. “CARD HOLDER” – refers to a person issued with a 24k Card

d. “ISSUER”- P.J. Lhuillier, Inc. (Cebuana Lhuillier)

e. “SERVICES” – all the services provided by P.J. Lhuillier, Inc. via 24k Online Website’s card holder, and “Service” means any one of them.

f. “REGISTER/REGISTRATION” – to create an account on the 24k Online Website.

g. “ACCOUNT” – refers to the 24k membership and/or 24k Online Website account.

2. THE CEBUANA LHUILLIER 24k CARD (“24k CARD”)

The 24k Card is the sole property of P.J. Lhuillier, Inc. (Cebuana Lhuillier). The Issuer reserves the right to revoke, terminate, withhold, or suspend the card’s privileges if it is found to be misused by the Card Holder, in accordance with these Terms & Conditions. The Card Holder agrees to hold the Issuer free and harmless from any claim for damages resulting from such actions.

3. RESPONSIBILITY OF CARD HOLDER

The Card Holder is fully responsible for all transactions made using the 24k Card. In the event of a lost 24k Card, the Card Holder must execute a notarized Affidavit of Loss and visit any Cebuana Lhuillier branch to request a replacement. The client is advised to present a valid identification document, as Cebuana Lhuillier branch personnel will conduct KYC (Know Your Customer) verification. A fee of PHP 100.00 will be charged for the card replacement.

4. MEMBERSHIP

All Cebuana Lhuillier clients and existing 24k card holders are eligible to avail of the 24k Card by transacting at any Cebuana Lhuillier branch.

5. TERMS OF USE

By accessing and using this website (“24k Online Website”), the Card Holder agrees to be bound by these Terms and Conditions of Use. The Issuer reserves the right to amend these terms at any time, as deemed necessary, and will notify clients of any changes made at least sixty (60) days in advance through public notice and/or email, SMS notifications, push notifications through the Company’s applications, and other official communication channels. Individual notifications will also be sent to all 24k Card Holders within the same period. If the Card Holder disagrees with any of these Terms and Conditions, the Card Holder must immediately discontinue the access to 24k Online Website and its services. Continued use of website shall constitute the Card Holder’s acceptance of these Terms and Conditions, including any future amendments.

6. APPLICABILITY OF TERMS AND CONDITIONS

The use of any Services and/or the 24k Online Website is subject to these Terms and Conditions of Use. 24k Online Website can be accessed through a desktop, PC, or mobile device using a web browser. User must register to utilize the 24k Online Website. 24k Online Website will be made available to Card Holders with no fee, unless otherwise determined by the Issuer.

The 24k Online Website is completely customer self-service where Card Holder shall enter/provide the 24k card number and preferred password. The Issuer recommends the use of a strong but easy to remember log in details.

24k Online Website processes financial and non-financial transactions such as: View Points, Domestic and International Partner Search, Domestic Remittance Tracking, Branch Locator, Appraisal Calculator, Online Appointment, Buy e-Load Using Points, Get Coupons Using Points, Change Password, Change eServices PIN, and View Personal Information.

The Card Holder may use 24k points to avail of the Services offered. All transactions require confirmation from the account holder before they are completed. Once confirmed and the corresponding 24k points have been deducted, the transaction is considered final. Please note that points used to redeem Services are non-refundable.

The Issuer reserves the right to change, modify, substitute, suspend, or remove any information, services, or features available on the 24k Online Website, and may also introduce new functionalities or services from time to time. Clients will be informed of any such changes at least sixty (60) days in advance through public notices and the Company’s official communication channels. Additionally, individual notifications will be sent to all 24k clients within the same period, and relevant announcements will be posted on the official website.

Access to the 24k Online Website and its services may occasionally be restricted to allow for system maintenance or repairs. In such cases, a notification will be posted to inform clients. The Issuer will make all reasonable efforts to restore access as soon as possible.

The Issuer reserves the right to block access and or edit or remove any material which in our reasonable opinion may give rise to a breach of these Terms and Conditions of Use.

Card Holders are responsible for ensuring the security of their PC, mobile devices, SIM cards and 24k Online Website login credentials (such as User ID and password) secure. Any transactions made using these – whether authorized or unauthorized- will be the responsibility of the Card Holder if they result from the Card Holder’s own negligence or actions. To help protect the account, it is strongly recommended that Card Holders regularly update their password,

especially if there is reason to believe that their account details may have been compromised. It is the Card Holder’s sole responsibility to change their password through 24k Online should there be a reasonable suspicion of a security breach, in order to prevent unauthorized access to their account. The Issuer shall not be liable for any unauthorized use or misuse of the 24k Online Website resulting from the loss or theft of the Card Holder’s PC, Mobile Device or SIM card.

8. PARTICIPATING PERSON

Only Card Holders of the 24k Card are eligible to participate in the Rewards Program.

9. PRIVILEGES

  • The Card Holder is entitled to discount on transaction fees and certain privileges in selected merchants and partner establishments.
  • The Card Holder is also entitled to special service offerings and other exciting offers or freebies.


10. EXPIRY OF REWARD POINTS

All points earned during the January 1 – December 31 period will expire on April 30 of the following year. Points not redeemed by this date will be expired and removed from the member’s points wallet.

Example: January 2025 – December 2025 earned points will expire on April 30, 2026.

Expiration dates are final and no extensions or reinstatements will be granted under any circumstances.

11. ACCREDITED ESTABLISHMENT

The 24k Card is intended to be honored at all accredited merchants. While the Issuer will make reasonable efforts to ensure merchant compliance, it shall not be held liable in the event a merchant refuses to honor the card. Card holders are encouraged to report such incidents, and the Issuer will assist in resolving the concern where possible.

12. ACCOUNT AND/OR MEMBERSHIP TERMINATION

In the event the Card Holder:

(i) fails to comply with any of the terms and conditions governing the use of the 24k Card, or

(ii) for any reason, the Card Holder passes away, the right to use the 24k Card shall be immediately terminated, without the need for prior notice or demand, which the Card Holder hereby waives.

The Issuer reserves the right, at its sole discretion and with or without notice, to terminate the Card Holder’s account, cancel any transactions, temporarily or permanently withhold points, and/or take any other actions that the Issuer deems necessary. Such actions may be taken based on a reasonable assessment of any of the following:

(a) Violation of these Terms and Conditions;

(b) Engagement in illegal, fraudulent, harassing, defamatory, threatening, or abusive conduct;

(c) Creation of multiple user accounts; and

(d) abuse of coupons/promotions, or similar offers. This clause is without prejudice to any other remedies available to the Issuer under applicable Philippine laws.

13. PROHIBITIONS

The Card Holder must not misuse the 24k Online Website and any of its services. The Card Holder shall not use any automated systems or software to extract data from this platform for any purpose. The Card Holder shall not commit or encourage a criminal offence, transmit or distribute a virus including but not limited to Trojan horse, worm, logic bomb or post any other material on the platform which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into; corrupt data; cause annoyance to other users; commit fraud, infringe upon the rights of any other person’s proprietary rights; send any unsolicited advertising or promotional material; or attempt to affect the performance or functionality of any computer facilities of or accessed throughout the platform. In the event such breach occurs, the Issuer will report the breach to the relevant law enforcement authorities and appropriate legal action will be taken.

All unredeemed rewards points including rewards points pending credit into the account of the Card Holder shall immediately become invalid, and shall be forfeited upon the occurrence of fraud and abuse relating to the earning of rewards points in the rewards program or redemption of rewards items, as reasonably determined by the Issuer.

14. LIMITATION OF LIABILITY

In the event that the Card Holder files any claim against the Issuer for any reason, the Card Holder agrees that the Issuer’s liability, if any, shall be limited to the lesser of a:

(a) One Thousand Pesos (Php1,000.00) or

(b) the actual damages actually proven to have been suffered by the Card Holder.

15. NON-WAIVER OF RIGHTS

No failure or delay by either the Issuer or the Card Holder in exercising any right or power under these Terms and Conditions shall operate as a waiver of such right or power. Likewise, any partial or single exercise of any right or power shall not preclude the full or future exercise of that or any other right or power.

Any waiver of rights by either party shall only be effective if made in writing and signed by the duly authorized representative of the party waiving such right.

16. ASSIGNMENT/TRANSFER OF RIGHTS

All rights and interests of the Issuer under this Agreement may be assigned or transferred to a third party, provided that the Card Holder is given prior written notice. Such transfer shall not affect the Card Holder’s existing rights and obligations under this Agreement.

17. COMPLIANCE

The Card Holder agrees to fully comply and abide by the terms and conditions governing the use of the card, laws, statuses and regulations and other access devices in commercial transactions.

18. BINDING EFFECT

These Terms and Conditions are binding upon the Issuer and the Card Holder, including their respective heirs, executors, administrators, successors, and assigns. By using or activating the 24k Card, the Card Holder confirms that they have read, understood, and agreed to these Terms and Conditions.

P.J. LHUILLIER, INC. respects our customers’ fundamental right to privacy, and we commit to take great care in safeguarding your personal data. We have developed a Privacy Policy that aims to ensure that we adopt and observe appropriate standards for personal data protection in compliance with Republic Act No. 10173 or the Data Privacy Act of 2012 and its implementing rules and regulations.

While our Privacy Policy sets out the general principles that govern the collection, use, and disclosure of our customers’ personal information, we have also developed this Privacy Commitment to inform you more specifically about our privacy practices.

Why we collect your personal information

As a member of the 24k Rewards Program, we collect and maintain some basic information about you. We do so only for the following purposes:

  • To create and nurture a relationship with you, so that we can continuously provide you with the various services and perks made available by the 24k Rewards Program. For example, when you submit your application form to join the Program, we collect personal information about you that will allow us to validate your identity and transaction history to determine if you are qualified to receive reward points.
  • To improve our Program. We collect, use, process, and analyze your Program related activities so that we can understand how to improve our Program for your benefit.
  • To understand your needs and preferences so that we can serve you better. Maintaining a record of the products and services that you avail the 24k Rewards Program allows us to gain a better insight of the kinds of offers that would be relevant to your preferences. We may send you product recommendations and special offers that we think will interest you.
  • To continuously improve our business and operations. For example, we provide customer care activities, monitor the quality and security of the network, train our staff, and plan for future growth.
  • To meet legal and regulatory requirements. We perform such other processing or disclosure that may be required to comply with pertinent laws, rules, or regulations.

Most of the personal information we have are those that you have given us yourself. You provide us personal information when you:

  • Apply for membership by filling out Application Forms, Subscription Agreements, and other similar or related documents through any of our available channels, including any similar forms you submit to your service providers (online, in our stores, or through our Sales representatives);
  • Get in touch with us to ask about something or request for service;
  • Take part in our research and surveys;


What information do we process

To process general inquiries or concerns about the products and services we offer:

To process your transactions covered by RA 9160, Anti-Money Laundering Law Act of 2001, as amended:

  • Name
  • Present address
  • Date and place of birth
  • Nature of work, name of employer or nature of self-employment/business
  • Contact details
  • Specimen signature
  • Source of funds
  • Permanent address
  • Nationality
  • Identification Cards
  • Name, present address, date and place of birth, nature of work and source of funds of beneficial owner or beneficiary, whenever applicable
  • When the customer or authorized representative is a foreign national, passport or Alien Certificate of Registration issued by the Bureau of Immigration


As part of due diligence, we may collect information about religious affiliation in the event the date of birth cannot be provided (due to religious beliefs) as this is required information under the law.

If reasonably necessary, we may also process your sensitive personal information such as credit card details.

We also collect information as you avail of the services of the Program, like when you

  • Use our facilities and services;
  • Use our apps, websites, and self-service channels and portals;
  • Join Program activities


Information we collect from other sources

We also collect personal information about you through other activities such as our market research initiatives, when you visit and transact in our stores, when you visit and use our website, and from our subsidiaries, affiliates, and third-party business partners to whom you have given your consent for them to share your information with us.

When we disclose personal information

There are a variety of circumstances where we may need to share some of the information that you have provided to us. In these cases, we ensure that your personal information is disclosed on a confidential basis, through secure channels, and only in compliance with the Data Privacy Act.

We will never share, rent, or sell your personal information to third parties outside of PJLI. Except in special circumstances where you may have given your specific consent for, and as described in this policy.

In some instances, we may be required to disclose your personal information to our agents, subsidiaries, affiliates, business partners and other third-party agencies and service providers as part of our regular business operations and for the provision of our products and services. This means we may share your information with:

  • Our service providers, contractors, and professional advisers who help us provide our products and services. This includes partner companies, organizations, or agencies, and their sub-contractors;
  • Our Subsidiaries and Affiliates with whom you have also signed-up with. We do so only for the improvement of each other’s business and operations;

How we protect your personal information

The integrity, confidentiality, and security of your information are important to us. That’s why we strictly enforce our Privacy Policy within PJLI and have implemented technical, organizational, and physical security measures that are designed to protect your information from unauthorized or fraudulent access, alteration, disclosure, misuse, and other unlawful activities. These are also designed to protect your information from other natural and human dangers.

We also put in effect the following safeguards:

  • We keep and protect your information using industry-standard security like firewall, encryption and security controls;
  • We keep your information only for as long as necessary for us to (a) provide the products and services that you avail from us, (b) for our legitimate business purposes, (c) to comply with pertinent laws, and (d) for special cases that will require the exercise or defense of legal claims;
  • We restrict access to your information only to qualified and authorized personnel who are trained to handle your information with strict confidentiality.

What your choices are

You are afforded certain rights in relation to your personal data under the Data Privacy Act. We would like to ensure that we have your consent to continue to collect, use, and disclose your personal information for the purposes that we have identified. At the same time, we want you to know that you do have choices and can object or withdraw your consent and/or edit your consent preferences at any time.

What happens when there are changes in our Policy

From time to time, we may update our privacy policy and practices to comply with changes in applicable laws, to comply with government and regulatory requirements, to adapt to new technologies and protocols, to align with industry best practices, and for business purposes.

We analyze data about how you use our products and services to help us manage your account better, to provide you with customer care activities, to ensure your fair use of our products and services, to monitor the quality and security of our technology, to train our staff, and to plan for our future growth. We do this so that we can continue to provide you with the best experience for the products and services that you avail from us.

4. The improvement of our products and services.

We analyze how you use our products and services so that we can understand how to improve them for your benefit. Our analysis may include some sensitive information about your usage, such as the general locations and sites that you may frequent. In all cases, we ensure to aggregate and anonymize this information so that you are never identified as an individual.

* Aggregating simply means presenting information in segments or categories like age groups; anonymizing means removing information that can personally identify you from the data.

5. Sending you product recommendations, special offers, and promos.

We will send you offers that we think will interest you. We keep a record of the products and services that you avail from us so that we can gain a better insight of the kinds of offers that would be relevant to you. We also analyze the places where you may have used our products and services and use this information to send you exclusive offers available in locations that you may frequent. 6. To interact with you on Social Media.

We place advertisements about our latest products and promotions on some of the most popular Websites, Social Media, and Search platforms. We may share information such as your mobile number, e-mail address, and cookies (from when you visit our websites) with the likes of Facebook and Google, to ensure that advertisements about our special offers are seen by you, as you browse their websites and apps.

7. Compliance with other legal and regulatory requirements.

We perform other activities and disclose data in cases where we are required to do so for us to comply with government laws, rules, or regulations and with other legal processes and orders.

There are some instances where we may need to share your information to our subsidiaries and affiliates, agents, business partners and other third-party agencies and service providers. We only share your information to enable us to continue providing you with the products and services that you have availed from us, and as part of our regular business operations that allow us to serve you better.

Data Subjects Rights

The Data Privacy Act of 2012 (Republic Act No. 10173) gives you rights in relation to the personal data that we have collected about you, the right to be informed of the purpose why we collect your personal data, the right to object to certain ways in which we may use your data, the right to access your data at your request, the right to correct any inaccurate or outdated data about you, the right to data portability, the right to file a complaint, and the right to erase or remove your data from our records.

Limitation on Rights

The foregoing rights with respect to your PI shall not apply to the processing of personal data gathered for the purpose of investigations in relation to any criminal, administrative or tax liabilities that you may have, provided that we will process the same only to the minimum extent necessary to achieve the purpose of said investigations.
